Waiver, Cart, and Declaration

WAIVER, CART, AND DECLARATION (collectively the “Waiver”)

I agree to the Waiver policy.

All Minors MUST be at least 16 years of age and provide a Drivers Permit or Valid Drivers License in order to use the said Club Car.
All youth under the age of 18 MUST have a Legal Guardian or Parent sign this form in order for the youth to be able to use the said Club Car.
Every member, guest, or visitor to Stoneybrook West Golf Course and is ancillary facilities (the “Club”) must read and complete this Waiver before being on the Owner’s property and before participating in Club activities (as defined below)
1. I hereby agree to pay for all damages that are sustained to the golf cart I am renting while in my possession, and assume all risks while operating the cart. I represent that I am familiar with the operation and use of this cart, that I can operate and control the same, and will follow all cart operations rules.
2. I understand that this Waiver is made for the benefit of Stoneybrook West Master Association, Inc. (“Owner”) and Tamarack Golf Management, LLC (“Manager”) and each of their directors, officers, employees, volunteers, coaches, lessees, and agents. I am a customer of the Club regardless of if I pay to participate in Activities (as defined below) of the Club, am a guest of the Club or if I am visiting the Club (the “Customer”). I acknowledge that if I am accompanied by a minor, and confirm that all statements made herein are being made on behalf of such minor and are complete and truthful. All drivers must be at least 16 years of age and possess a valid Drivers License. If a driver is 15 years or younger, they must be part of a Golf Team and be supervised by a coach, parent or guardian and must sign this Waiver on behalf of the minor.
3. I understand that there are inherent risks (the “Risks”) associated with the game of golf, the use of golf equipment, the use of golf power carts, the use of the Club’s facilities, and participation in sports, fitness, instruction, food and beverage services, and all other activities, services, programs or events provided or organized by the Club (the “Activities”).
4. I am aware that the risks include the potential for serious personal injury, death or property damage. I understand that risks may be relative to my own state of fitness and health (including physical, mental and emotional), and to the awareness, care and skill with which I conduct myself.
5. I freely accept and fully assume all responsibilities for all Risks and possibilities of personal injury, death, property damage or other loss resulting from my own participation in the Activities. I accept these Risks and agree to the terms of this Waiver, even if the Manager or Owner are for to be negligent or i breach of any duty of care or obligation to me in ay way in respect of the Activities.
6. In addition to consideration provided to the Club for my participation in Activities, being on the Club property and rental and use of our club car, I am my heirs, next of kin, executors, administrators and assignees agree:
a. to waive all claims that I have or may have now or in the future agains the Owner, Manager and Employees;
b. to release and forever discharge the Owner, Manager and Employees from all liability for all personal injury, death, property damage or other loss resulting from my participation in Activities due to any cause, including but not limited to negligence, breach of any duty imposed by law, breach of contract or mistake or error judgement of the Owner or Manager;
c. to release and forever discharge the Club from all liability for all personal injury, death, property damage or loss resulting from any infectious disease, virus, bacterium or other microorganisms (whether asymptomatic or not).
D. To be liable for and hold harmless and indemnify the Owner, Manager, and Employees from all actions, proceedings, claims, costs, demand including court costs and attorney’s fees and other liabilities whatsoever nature or kind arising out of or in any way connected with me, my agents or any minor at the Club with me participating in the Activities.
7. I agree that this Waiver shall remain in full force and effect for all visits by me to the Club whenever they occur and that entry onto the Club property is conditional upon agreeing to the terms of this Waiver.
8. I agree that the Club Car I have been given is in good running condition and is absent of any significant cosmetic, structural or mechanical flaws. I acknowledge that I am responsible for returning the Club Car in the same condition after the lesson or found and will be charged for any damages incurred to the said Club Car. I assume all risks associated with the operation of the Club Car and further agree to indemnify and hold Stoneybrook West Golf Course, it’s officers, directors, agents and employees free and harmless from ay all liability or claims of any nature whatsoever, including Attorney’s fees, that might arise or through possession or use of the said Club Car.
9. I agree that this Waiver and all terms contained within are governed by the law of the State of Florida. I hereby confirm that I have read and understand each term and irrevocably submit to the jurisdiction of the Courts of the State of Florida. Any litigation to enforce this Waiver will be instituted in the State Court of Orange County, Florida.

I agree to the credit card policy regarding minors renting golf carts.

A major U.S. credit card must be presented at time of cart rental for a user under the age of 18 years old (hereinafter referred to as "minor") to guarantee the condition of the vehicle until it is inspected at the conclusion of the rental. Cart must be returned in the same condition as when the rental was initiated. Minor and "Customer" (as noted on this form) is responsible for missing or damaged carts, including any damage to, or damage caused by the cart. Any minor who causes damage to a golf cart, golf course, or any part of the golf facilities is responsible for repair or replacement costs. Minor shall immediately report any damage to Stoneybrook West Golf Club.
